Kenyan activists file new petition against presidential re-run

Nairobi, Kenya, November 6 (Infosplusgabon) - A fresh election petition has been filed challenging the election of President Uhuru Kenyatta on the grounds the poll officials who conducted the vote were illegally appointed.

 

President Kenyatta was declared winner of the 26 October presidential contest with 98.26% of some 7.6 million people who voted in the election.

 

Njonjo Mue, the petitioner, said on Monday that the election failed the principle of universal suffrage because a vast majority of the voters did not participate.

 

The petitioner also said that non-gazetted officials signed the election result documents, which make those particular results null and void.

 

The petitioner also stated the election did not meet the constitutional requirements, especially in Article 81, which requires an independent electoral body to conduct such an election.

 

The petitioner also states President Uhuru Kenyatta did not receive a new certificate of nomination before participating in the fresh election.

 

According to the petition, the Independent Electoral and Boundaries Commission  (IEBC), was trying to "revive" a "dead election" which is reference to the withdrawal of candidate Raila Odinga from the race.

 

The latest election petition follows one filed filed by Haroun Mwau, a politician and a business executive, stating the election body erred when it failed to conduct fresh nominations for the presidential candidates.

 

The petitioners also stated there was no fairness because some two candidates were allowed to campaign for 48 days while others were included on the ballot less than 48 hours to the vote.
